Abstract:
Organ transplantation means the process of getting rid of the disease by placing the organs in
the body of a recipient struggling to survive and the organs can be transplanted either from a
living or a deceased donor. Ijtihad on organ transplantation has been made by the Islamic
Scholars as individual or in combination and Fatwas have been submitted. the research has
been carried out on the basis of the objectives such as examining the aforesaid fatwas in
keeping with legal maxims and enlightening the Sri Lankan Muslims about how Shariah
focuses on organ transplantation. This research can be known as a library Research in respect
of Qualitative Method. Data were gathered from the secondary sources such as research
Articles, web publications, newspapers and books, the Islamic sources namely Al-Qur’an,
Sunnah and opinions of the contemporary Islamic Scholars and fatwas of International Islamic
Fiqh Academies. All the received data were analyzed through Data analytical method and the
information were organized and forwarded. According to the results of the study, A Sri
Lankan Common Law has permitted the Muslims living in the prevailing circumstances in Sri
Lanka to the Act of transplanting organs and the research perform in conclusion has it that all
the fatwas addressed by Islamic fiqh academies that are in operation in the Countries like
Singapore, Malaysia, America and India are authentic based on Islamic Legal Maxims.
